1. Who we are

Madrid Jets (operated by Private Jet Charter S.L.) is an air charter broker acting solely as an intermediary between third-party aircraft operators and the client. Madrid Jets arranges air transportation by chartering aircraft from the operator, acting as an agent for and on behalf of the client. Madrid Jets does not operate aircraft itself, is not a direct or indirect air carrier, and does not provide air transportation services.

This website is operated by Private Jet Charter SL, trading as “Madrid Jets” (“we”, “us”, “our”), a company incorporated in Spain , tax identification number B22459614.

Private Jet Charter SL is the data controller for the personal data described in this policy. We have not appointed a Data Protection Officer, as we are not required to do so. If you have any question about this policy, or about how we handle your personal data, write to madridjets@madridjets.com

2. What this policy covers

This policy explains what personal data we collect when you visit madridjets.com, request a quote, correspond with us by email, telephone or WhatsApp, or charter a flight through us. It also explains why we use that data, who we share it with, how long we keep it and what rights you have over it.

It does not cover the websites or services of aircraft operators, handling agents or other third parties we may introduce you to. Those organisations have their own privacy policies.

3. Our role as a broker

We are a charter flight broker. We do not operate aircraft. In order to quote for a flight and then arrange it, we have to pass details about you and your passengers to the aircraft operator, to handling agents and, where applicable, to airport, customs and border authorities. Those parties act as data controllers in their own right for the purposes of operating the flight and of complying with aviation, customs and immigration law.

4. The personal data we collect

4.1 Data you give us

  • Identity and contact details: your name, email address, telephone number and, where you provide it, your company name.
  • Trip details: departure and arrival airports, dates and times, number of passengers, aircraft preferences and anything else you include in the quote form or in your messages to us.
  • Correspondence: the content of emails, WhatsApp messages and web form submissions, and notes taken during telephone calls.

4.2 Data we need in order to confirm a flight

  • Passenger details for every person travelling: full name, date of birth, nationality, and passport or identity document number and expiry date. We request these at the flight confirmation stage because the operating carrier and the relevant border and security authorities require them.
  • Billing and payment details: the invoicing name and address and the banking details used to settle the charter.

4.3 Data we collect automatically

  • Technical and usage data: IP address, browser type and version, device type, operating system, the approximate location derived from your IP address, and the pages you view on this site.
  • Cookies and similar technologies, as described in section 10 and in our Cookie Policy.

5. Special categories of data

We do not ask for health information. If you choose to tell us about a passenger’s medical condition, reduced mobility, assistance requirement or dietary need so that the flight can be arranged accordingly, we treat that information as a special category of personal data under Article 9 of the GDPR. We use it only to arrange that flight, we pass it only to the operator and suppliers who need it, and we rely on your explicit consent to do so. You may ask us to delete it once the flight has taken place.

6. Children

This website is not directed at children and we do not knowingly collect data from them directly. We process data about a minor only where that minor is travelling as a passenger and the details have been supplied by the adult making the booking.

7. Why we use your data, and our legal basis

  • To respond to a quote request and prepare an offer. Steps taken at your request prior to entering into a contract, Article 6(1)(b) GDPR.
  • To arrange, confirm and manage a charter flight, including passing passenger details to the operator. Performance of our contract with you, Article 6(1)(b) GDPR.
  • To collect the passport and identity details required for a flight. Compliance with a legal obligation and performance of the contract, Articles 6(1)(c) and 6(1)(b) GDPR.
  • To issue invoices and keep accounting and tax records. Compliance with a legal obligation, Article 6(1)(c) GDPR.
  • To answer general enquiries and maintain our business relationship with you. Our legitimate interest in running and supporting our business, Article 6(1)(f) GDPR.
  • To prevent fraud and secure our systems and this website. Our legitimate interest in protecting our business and our clients, Article 6(1)(f) GDPR.
  • To measure how this website is used, through analytics cookies. Your consent, Article 6(1)(a) GDPR.
  • To send you commercial communications about our services. Your consent, or our legitimate interest where you are an existing client and the communication concerns similar services, Article 6(1)(a) or 6(1)(f) GDPR.
  • To establish, exercise or defend legal claims. Our legitimate interest, Article 6(1)(f) GDPR.

We do not make decisions about you by automated means alone, and we do not carry out profiling that produces legal effects for you.

8. Who we share your data with

We do not sell your personal data, and we do not rent or trade it with unaffiliated companies for their own marketing. We share it only where it is needed, and only with:

  • Aircraft operators and their crew, for the flights you charter.
  • Ground handling agents, fixed base operators, catering companies and ground transport suppliers involved in your trip.
  • Airport, customs, immigration, security and other public authorities, where they require passenger information or where we are obliged by law to disclose it.
  • Our service providers, including our website hosting provider, our email provider, and the analytics providers described in section 10, all of whom act on our instructions under a data processing agreement.
  • Our banks, insurers, accountants and legal advisers, where relevant.
  • A buyer or successor, if the business is sold or reorganised, in which case your data would continue to be protected by this policy until you were told otherwise.

9. International transfers

Private aviation is international by nature. If your flight departs from, arrives in or transits a country outside the European Economic Area, your data and your passengers’ data will be transferred to the operator, handlers and authorities in that country. Where a transfer of that kind is necessary in order to perform the charter contract, it is made under Article 49(1)(b) of the GDPR.

Where one of our own service providers is located outside the EEA, we rely on a European Commission adequacy decision for that country or, failing that, on the Standard Contractual Clauses approved by the European Commission, together with any additional safeguards that may be required. You can ask us for details of the safeguards applied to a specific transfer.

10. Cookies, analytics and advertising

This website uses cookies and similar technologies. Cookies that are strictly necessary for the site to function are always active. Cookies used for statistics, marketing or personalisation are only placed after you have accepted the corresponding category in our cookie banner.

We use Google Tag Manager as the container that loads the tags on this site. Tags that are not strictly necessary, including web analytics, are blocked until you give consent for that category. Where analytics are enabled, the resulting reports tell us how many people visit the site and which pages they use, not who those people are.

You can change or withdraw your cookie choices at any time from the cookie settings on this site, and you can block or delete cookies through your browser settings. Blocking strictly necessary cookies may stop parts of the site working. The full list of cookies actually in use, with their purpose and duration, is kept in our Cookie Policy.

11. Marketing

If we send you commercial communications, every message includes a link to unsubscribe, and you can also opt out at any time by writing to madridjets@madridjets.com.  Opting out of marketing does not stop the operational messages we need to send you about a flight you have booked.

12. How long we keep your data

  • Quote requests and enquiries that do not lead to a booking: up to 24 months from our last contact with you, after which they are deleted.
  • Booking files, contracts and correspondence relating to a completed flight: for the duration of the contract and then for the period during which a claim could be brought, and in any event for as long as Spanish commercial and tax law requires us to keep the underlying records.
  • Passport and identity document details: deleted once the flight has been completed and the associated obligations discharged, unless we are legally required to retain them for longer.
  • Invoices and accounting records: six years from the end of the relevant financial year, in line with the Spanish Commercial Code, and four years for tax purposes.
  • Marketing consents and opt-outs: until you withdraw your consent, and then a minimal record of the fact that you opted out, so that we can honour it.
  • Cookie data: for the periods set out in the Cookie Policy.

13. How we protect your data

We apply technical and organisational measures appropriate to the risk, including encryption of the connection to this website, access controls and authentication on the systems that hold client data, restriction of access to the staff who need it, and confidentiality obligations for everyone who handles it. We require the same standard from the service providers who process data on our behalf.

No transmission over the internet can be guaranteed to be completely secure. If a personal data breach occurs that is likely to result in a risk to your rights and freedoms, we will notify the competent supervisory authority and, where required, you.

14. Your rights

Under the GDPR and Spanish data protection law you have the right to:

  • Ask for access to the personal data we hold about you, and for a copy of it.
  • Have inaccurate or incomplete data corrected.
  • Ask us to delete your data, where we no longer have a valid reason to keep it.
  • Ask us to restrict how we use your data while a request or an objection is being resolved.
  • Object to processing that we carry out on the basis of our legitimate interests, and to object to direct marketing at any time.
  • Receive the data you provided to us in a structured, commonly used and machine readable format, and have it transmitted to another controller, where that is technically feasible.
  • Withdraw your consent at any time, where we rely on consent. Withdrawing consent does not affect the lawfulness of what we did before you withdrew it.

To exercise any of these rights, write to madridjets@madridjets.com. We may need to confirm your identity before we act, and we will respond within one month, extendable by two further months for complex requests, in which case we will tell you.

15. Complaints

If you believe we have not handled your personal data properly, we would like the chance to put it right, so please contact us first. You also have the right to lodge a complaint with the Spanish supervisory authority, the Agencia Española de Protección de Datos, C/ Jorge Juan 6, 28001 Madrid, www.aepd.es, or with the supervisory authority of the EU country where you live or work.

16. Changes to this policy

We may update this policy to reflect changes in how we work or in the law. The version published on this page is the version that applies, and the date at the top shows when it was last revised. Where a change is significant, we will make that clear on the website.
